SALE AGREEMENT

  • These online terms and conditions of sale (“Agreement”) apply to all products (“Products”) purchased via www.guess.co.za (“Website”) from GUESS a division of Guess South Africa (Pty) Ltd (“GUESS” or “We” or “Us”) whose registered office is 1 Saagmeul Rd, George Industria, Western Cape, South Africa.
  • The references to “You” refer to you being the individual person or juristic person to whom We market or supply the Products. You must be 18 years or older to enter into this Agreement or You must be assisted by Your legal guardian.
  • This Agreement will apply to any Products bought via the Website and it will come into effect and become legally binding, when We have received Your order via the Website (“Order”) and payment in respect thereof and have accepted the Order by confirming Your Order and issuing You with an order confirmation (“Order Confirmation”) via email.
  • Please note that placing Your Order does not mean an acceptance of Your Order. It must first be confirmed by Us and all Orders are subject to availability of stock and receipt of payment.
  • The current Agreement in place at the time of the Order will be the Agreement applicable to Your Order. We reserve the right to vary or amend the terms of this Agreement from time to time with regards to future Orders.

PRODUCTS AND PRICES

  • The images of the Products on the Website are for illustrative purposes only and may differ from the actual Products.
  • The Product prices are inclusive of valued added tax and are as displayed on the Website at the time of the Order. These prices exclude delivery charges, which (where applicable depending on the value of the Order) will be displayed on the Website when You Checkout and select Pay.
  • We reserve the right to change the prices of the Products on the Website, from time to time, without prior notice. While We will do our best to ensure the accuracy of the prices displayed, We will not be liable for prices that are obviously incorrect or have been amended without Our authorisation. In this instance, We will contact You to confirm whether you would still like to Order the Item at the correct price.
  • The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

PLACING YOUR ORDER

  • Select the Products You wish to purchase by adding them to Your cart. When you are finished shopping, select Checkout and once you are happy with Your Order and have provided all the required information (including the payment method), select Pay and you will be re-directed to the applicable payment site.
  • Your Order Confirmation will be sent to you via email and the original invoice will accompany Your delivery. You will be able to track Your Order via Our delivery company’s tracking mechanism as advised to You.
  • Payment may be made via Visa, MasterCard, or by Secure EFT, the details of which will be provided on request.
  • Card transactions will be acquired for GUESS SOUTH AFRICA via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. RISK AND OWNERSHIP

GUESS SOUTH AFRICA takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

All risk in and to all Products shall pass to You upon successful delivery. Ownership in the Products shall remain vested in Us until the full purchase price has been paid and received by Us.

COOLING OFF PERIOD

  • In terms of the Electronic Communications and Transactions Act, if You are a natural person (meaning an individual and not a juristic person or a company), You are entitled to cancel Your Order for the Products purchased via the Website, without reason and without penalty, within 7 days of the Products having been delivered to You. To exercise your cooling off right you must notify Us in writing at [email protected] within 7 days of delivery. 
  • If You elect to exercise this cooling off right, You:
    • will receive a full refund of the price paid by You for the Products within 30 days of the date of cancellation. You may be liable for the direct costs of returning the Products to Us, such as returning the Products via courier and/or shipping charges; and
    • undertake not to utilise the Products and return the Products in the original and unopened packaging.

COUNTRY OF DOMICILE

This website is governed by the laws of South Africa and GUESS SOUTH AFRICA chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

LEGAL MATTERS

  • The physical address provided by You when ordering Products on the Website shall be Your domicilium address for all purposes in terms of this Agreement, for the giving of any notice, and the serving of any process. Our chosen domicilium address is set out in clause 1.1 above.
  • A notice in terms of this Agreement shall be presumed to have been duly given, if delivered by hand, on the date of delivery and if sent by post, 7 days after posting.
  • This Agreement represents the entire agreement between GUESS SOUTH AFRICA and You. No amendment to this Agreement shall be of any force and effect unless reduced to writing and agreed by You and GUESS SOUTH AFRICA.
  • This Agreement shall be governed and construed in accordance with the laws of South African and You hereby consent and submit to the jurisdiction of the courts of South Africa.

 

COMPETITION TERMS AND CONDITIONS

  1. COMPETITION
    • 1 This GUESS Women’s Month “Purchase & stand a chance to win a GUESS Silvana 2 Compartment Tote, Bella Vita Rosa Fragrance Gift Set & a Pair of GUESS Rose Gold Heart Earrings all to the value of R4,500.00 (four thousand five hundred Rand)” competition (“Competition”) is organised and conducted by Guess South Africa (Pty) Ltd (“Promoter”).
    • This online and in-store Competition commences at 00:01 on Wednesday 09 August 2023 and closes at 23:59 on Thursday 31 August 2023 and entries received after the closing date will not be considered. There are no entry fees to participate in the Competition.
  1. ENTRY CONDITIONS
    • Participants must be 18 years or older and have a valid identity document, passport or work permit and must reside in the Republic of South Africa during the period of the Competition (“Participants”/”you”/”your”). Competition entries are restricted to 1 per Participant and accordingly multiple Competition entries are prohibited.
    • Participants may not enter or receive a prize if they are directors, members, partners, employees, agents of or consultants of the Promoter, its subsidiaries, holding companies, divisions and/or associated companies or of the advertising or promotion agencies or any other person who directly or indirectly controls or is controlled by the Promoter or their spouses, life partners, immediate family members or business partners.
    • By entering this Competition, all Participants agree to be bound by these terms and conditions, and the Promoter’s decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into.
    • Entry into this Competition is only possible via the link(s) below or as described in clause 3.1 below and no responsibility will be accepted for any entry that is not delivered, received or is delayed or damaged due to technical reasons, including telecommunication failure on the part of any third party service provider or otherwise.
  1. HOW TO ENTER
    • To enter this Competition all You need to do is purchase any GUESS product(s) online or in-store between the dates of 9 August 2023 and 31 August 2023.
    • There is no spend limit to enter.
    • You need a valid till slip or online order.
    • You will automatically be entered into the Competition when you have completed the purchase and payment has been confirmed for online purchases.
    • In-Store you can scan a QR code that will be located at the POP, where you will enter all our details (Name, Surname, Email, Contact Nr, Store Details & Till Slip Number), once the form is complete you will click submit & entry will be made successfully.
    • Incomplete or incorrect entries will not be eligible to be entered into the draw and entries must be submitted by the Participant and not by a third party on the Participant’s behalf and prior to the Competition closing date.
  1. PRIZE
    • The Competition prize consists of 1 (one) GUESS Silvana 2 Compartment Tote, 1 (one) Bella Vita Rosa Fragrance Gift Set and a pair of GUESS Rose Gold Heart Earrings all to the value of R4,500.00 (four thousand five hundred Rand).
    • The Promoter reserves the right to substitute the prize for an alternative prize of equal or greater value should the prizes promoted not be available due to unforeseen circumstances.
    • No prize is transferable or exchangeable and may not be redeemed for cash.
  1. DETERMINATION OF WINNER
    • The prize will be awarded to 1 winner (“Winner”) and will be randomly drawn and awarded by the Promoter on 15 September 2023. The winning Participant will receive notification of potentially winning the Competition by telephone, as soon as is reasonably possible, after the draw has taken place.
    • All the information provided or related to this Competition shall be managed, captured, and approved by Promoter.
    • Promoter will share personal details of the winner, such as name and contact number, with a Promoter[1]approved third-party agency and/or GUESS Marketing, who will notify the respective winner that they have won in the Competition, and by participating in the Competition, entrants/participants agree to and accept such disclosure as is necessary to effect Prize fulfilment.
    • Promoter and GUESS Marketing will use reasonable efforts to contact the winner(s) via direct messaging on his/her/their social media profile, email, or telephonically as may be applicable on the contact details provided by the entrants/participants to participate in the Competition.
    • Promoter and GUESS Marketing shall attempt to contact the winner for a period of 2 (two) normal working weekdays after their name(s) have been drawn and verified as the winner. The winner will be contacted during normal working hours, between 8 (eight) in the morning and 5 (five) in the afternoon. Winner will be advised of arrangements in respect of Prizes at the time of contacting the selected winner.
    • Should an entrant/participant not be available on the contact details provided during the timeframe stipulated above or rejects, forfeit, or decline acceptance of the Prize, that person’s right to the Prize will be deemed to have been waived, and the Prize will be forfeited. Promoter reserves the right to then award the Prize to the next randomly drawn entrant/participant.
    • The claim for any Prize will be subject to security and validation, and Promoter reserves the right to withhold any Prize until it is satisfied that the claim by a particular winner is valid. The selected winner must be able to identify himself/herself/themselves, in a manner determined by Promoter, as the qualifying entrants/participants to the Competition and have to comply with the required validation procedure, determined by Promoter, in order to claim any Prizes, failing which such winner will forfeit the Prize and the Prize will be awarded to the next selected qualifying entrant.
    • Notwithstanding the fact that the Prizes vest in the winner immediately upon the determination of the results, in the event that the required documentation from a particular winner has not been received at the agreed cut-off date communicated to the winner, or no effort is made on the part of any of the winner to make special arrangements to meet the deadline set by Promoter, such Prize will be forfeited. Promoter then reserves the right to award the Prize to the finalist that is next in line.
    • Promoter shall request the winner’s consent in writing to their image and/a video recording of the winner receiving the prize being made and used by Promoter or likeness being used and published by Promoter and GUESS Marketing in connection with the Competition for a period of 12 (twelve) months after they have been announced as the winner. The winner may decline the use of their image and/or likeness by Promoter and GUESS Marketing.
    • The Promoter’s decision in terms of clause 5 shall be final and no correspondence will be entered into.
  1. PRIZE DELIVERY
    • The following general conditions apply to the delivery of Prizes, unless otherwise indicated.
    • Promoter will determine the mode of Prize delivery at its discretion.
    • In the event of a Prize requiring physical delivery – delivery will take place via courier at dates, times and places agreed to between Promoter and the winner(s). The winner must provide a correct address for delivery. Delivery may only be possible during weekdays (Monday – Friday) between 09h00 – 17h00, and not on Saturdays, Sundays, and public holidays. If the winner is not home for courier or delivery, or the address cannot be found, the winner will be offered one more opportunity to provide an accessible address for delivery and to be available for such delivery; if delivery is still not possible, the Prize will be forfeited.
    • In the event of a Prize requiring physical collection – the Promoter will communicate the address and location where and hours when the Prize can be collected by the winner(s). Neither Promoter nor GUESS Marketing shall be held liable should the winner(s) be unable to collect the Prize. Prize/s must be collected by the winner/s at the address and location and time agreed upon by the parties for collection, failing which the Prize will be forfeited.
    • In the event that a Prize can be sent electronically via email, a valid email address must be provided by the winner. If Promoter has sent the email containing the electronic Prize to the email address provided, delivery thereof will be deemed to have taken place. Promoter will be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.
    • In the event of data and/or airtime Prizes, all data Prizes will be allocated to the winner(s) within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the cell phone number that the data and/or airtime must be transferred to.
    • In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification.
    • Should Promoter not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited.
    • In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Promoter will share personal details of the respective winner(s), such as name and surname, and contact number, with a Promoter-approved third agency or GUESS Marketing, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.
    • If a winner cannot accept a Prize for any reason whatsoever, or if Promoter is unable to deliver the Prize (including for the reasons mentioned above), the Prize will be awarded to the next selected entrant.
    • All risks and ownership of the Prizes shall pass to the winner(s) on transfer/delivery thereof, and all of Promoter’s obligations regarding the Competition and Prizes shall terminate.
  1. Personal information and permission to receive marketing and promotional information
    • User data collected via the Competition will not be used for any other purpose than for the execution of the Competition and/or for the sharing of related marketing and promotional information.
    • User data collected via entry for this Competition will be stored for as long as it is legally required to and in accordance with Promoter’s Privacy Policy.
    • By entering this Competition, entrants/participants give Promoter permission to send them marketing or promotional information about Promoter’s products and other Competitions, and consent to their name, contact number, and/or email address being shared with official Partner/s in the campaign to which the Competition relates, for marketing or promotional purposes.
    • The entrant(s) will be given the option to opt out of receiving marketing or promotional information via the platform from which they receive such information.
  1. PUBLICITY AND DATA PRIVACY
    • The Winner(s) has the right to decline permission to use their name or image in marketing material or participate in any marketing activity. Should the Winner verbally or otherwise agree to it, the Promoter may publish the Winner’s name and image on its social media platforms and/or website, without any liability to the Promoter or remuneration due to the Winner.
    • By entering the Competition, the Participant acknowledges and agrees that his/her personal information will be shared with the Promoter and its agents to the extent necessary to conduct the Competition and for the prize, if applicable, to be delivered to the Winner.
    • All personal information relating to the Participants will be used, processed and stored solely in accordance with South African consumer and data protection legislation and the Company’s privacy policy which can be found at www.guess.co.za.
  1. GENERAL
    • The Promoter reserves the right to shorten, extend, suspend the time period of the Competition or terminate the Competition whenever it should so choose for technical, commercial, or operational reasons or for reasons beyond its control or generally for any reason whatsoever, its sole discretion. The Competition, its prize and terms and conditions may be amended by the Promoter, at any time during the Competition and will be applied and interpreted within the Promoter’s sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no recourse against the Promoter whatsoever.
    • All publicity and other materials and IP will be the sole property of the Promoter,
    • By participating in the Competition and to the fullest extent permitted by law, the Participant indemnifies, releases and agrees to hold harmless the Promoter, its associated, holding and subsidiary companies, its directors, officers, agents, representatives, organisers, contractors, shareholders, employees, successors and assigns from any and all claims and/or liabilities arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of the prize.

You might be the lucky one to walk away with a beautiful GUESS Rainee Quilt Heart Bag valued at R1999”. Competition (“Competition”) is organised and conducted by Guess South Africa (Pty) Ltd (“Promoter”).

    1.2 This Competition commences at 00:01 on Wednesday 7 February 2024 and closes at 23:59 on Thursday 29 February 2024 and entries received after the closing date will not be considered. There are no entry fees to participate in the Competition.

    3. HOW TO ENTER

     

    3.1 To enter this Competition all You need to do is :

    3.1.1 Scan the QR code in a GUESS store on an Easel.

    3.1.2 The QR code will open a link that directs you to a sign-up web page.

    3.1.3 Enter your details and submit.

    3.2 You can also enter by visiting the GUESS website and clicking on a web banner or the website pop up.

    3.3 Incomplete or incorrect entries will not be eligible to be entered into the draw and entries must be submitted by the Participant and not by a third party on the Participant’s behalf and prior to the Competition closing date.

     

    4. PRIZE

Promotor will not be held liable if delivery to such an email address fails or if the winner is unable to retrieve the email or Prize as sent to such email.

    6.6 In the event of data and/or airtime Prizes, all data Prizes will be allocated to the winners within seven (7) working days after the competition days after the competition winner(s) have been confirmed and the winner(s) details have been confirmed, including the cell phone number that the data and/or airtime must be transferred to.

    6.7 In the event of a cash Prize, the cash Prize will be transferred via EFT (electronic funds transfer) to the winner within seven (7) working days after the competition winner(s) have been confirmed and the winner(s) banking details confirmed by receiving proof of banking details and identification.

    6.8 Should Promoter not be able to fulfil their obligation in delivering the Prize(s) to the winner(s), for whatsoever reason, including due to lack of accurate information provided by the winner(s) or the winner(s) inability to receive the Prize, the Prize will be forfeited.

    6.9 In order to effect arrangements required for the Prize fulfilment in terms of this Competition, Promoter will share personal details of the respective winners, such as name and surname, and contact number, with a Promoter-approved third agency or Promoter’s Marketing team, for distribution of the Prize items, and by participating in the Competition, entrants/participants agree to such disclosure as is necessary to effect Prize fulfilment.

    6.10 If a winner cannot accept a Prize for any reason whatsoever, or if Promoter is unable to deliver the Prize (including for the reasons mentioned above), the Prize will be awarded to the next selected entrant.

    6.11 All risks and ownership of the Prizes shall pass to the winners on transfer/delivery thereof, and all of Promoter’s obligations regarding the Competition and Prizes shall terminate.

     

    7. PUBLICITY AND DATA PRIVACY

     

    7.1 The Winner has the right to decline permission to use their name or image in marketing material or participate in any marketing activity. Should the Winner verbally or otherwise agree to it, the Promoter may publish the Winner’s name and image on its social media platforms and/or website, without any liability to the Promoter or remuneration due to the Winner.

    7.2 By entering the Competition, the Participant acknowledges and agrees that his/her personal information will be shared with the Promoter and its agents to the extent necessary to conduct the Competition and for the prize, if applicable, to be delivered to the Winner.

    7.3 All personal information relating to the Participants will be used, processed and stored solely in accordance with South African consumer and data protection legislation and the Company’s privacy policy which can be found at www.guess.co.za.

     

    8. GENERAL

     

    8.1 The Promoter reserves the right to shorten, extend, suspend the time period of the Competition or terminate the Competition whenever it should so choose for technical, commercial, or operational reasons or for reasons beyond its control or generally for any reason whatsoever, its sole discretion. The Competition, its prize and terms and conditions may be amended by the Promoter, at any time during the Competition and will be applied and interpreted within the Promoter’s sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no recourse against the Promoter whatsoever.

    8.2 All publicity, I.P and other materials will be the sole property of the Promoter.

    8.3 By participating in the Competition and to the fullest extent permitted by law, the Participant indemnifies, releases and agrees to hold harmless the Promoter, its associated, holding and subsidiary companies, its directors, officers, agents, representatives, organisers, contractors, shareholders, employees, successors and assigns from any and all claims and/or liabilities arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of the prize.

RETURNS

While we take pride in all of our GUESS products, if you are not satisfied with your online purchase we are happy to assist you with a return.
We have a hassle free returns policy for online orders.
Either you may personally exchange your item in a Guess store nationwide, or via courier back to our online store. Our Returns Policy is designed to assist you with your exchange.
The benefits given by our Returns Policy are in addition to other rights and remedies you may have as a consumer under the Consumer Protection Act (CPA), as well as any other applicable acts.

Online Purchases will only be refunded by our online store.

We gladly accept the return or exchange of unworn, unwashed or defective GUESS merchandise to our GUESS online store. Guess Kids merchandise can be exchanged at Guess online or any Guess Kids store nationwide and refunds to our Online GUESS store only.

Marciano product to be exchanged to GUESS Online or any store stocking Marciano namely Menlyn, Mall of Africa, V&A Waterfront, Sandton City, Gateway, Brooklyn, Clearwater, Bedfordview and Eastgate. Marciano product to be refunded only at our GUESS Online store.

Exchanges or returns cannot be accepted at Guess Factory Stores, unfortunately.

All eligible online change of mind returns require:

  • Proof of purchase to issue any refund or exchange.
  • All returned items need to be unused, unwashed and in perfect condition, with swing/ price/ care tags attached and in their original packaging. We cannot accept returns of worn, damaged products, personalised or otherwise non-saleable products.
  • Items to be returned within 14 days of receipt/delivery of parcel

If you are not able to comply with these requirements, Guess reserves the right to refuse an exchange or refund on change of mind items.

RETURNING TO A STORE

Online purchases will only be refunded by our Online store. A refund will be provided to you by crediting your original method of payment.

If you however choose to return it via our traceable courier service, you will be charged a courier fee.

Returns are generally processed within 2 business days of receipt of the item at our distribution centre. Please allow 7 days from the day your return is processed for your account to be credited. Once your return has been processed you will be notified via the email address provided with your original online order. Delays in return processing may be experienced during busy sale and promotional periods, due to higher volumes.

We regret that we are unable to accept the exchange or return of the following items for change of mind for hygiene reasons:

GUESS online cannot process returns or exchanges for items that have been purchased in-store.

If you purchased your item from a retail store, please return the item to any Guess store within South Africa.

GUESS merchandise purchased from other retailers, including department stores, must be returned to the store from which it was originally purchased and is subject to the return policy of the originating retailer.

Item(s) purchased at any Guess store within South Africa can only be returned at a Guess store within South Africa.

If you decide to return something for any reason other than the item being defective, late delivery, or receipt of incorrect item then you will be responsible for the cost of returning the item to us. If the reason for the return is due to an error on our side, then we will cover the costs of returning the item.

Please note that cash refunds will not be provided under any circumstances and courier charges cannot be refunded. All refunds will be processed using the original payment method.

In the event that you prefer to use your own courier company or to post the goods we will only accept responsibility once we physically receive the goods at our warehouse. In the event that you elect to return the goods to us via this channel all risks will be for your account. If the postal service or Courier Company (other than our own courier company) loses the returned parcel the onus will be on the sender to resolve the issue of the lost parcel.

Please package all returned goods carefully so that the item does not become damaged en-route. Please include a copy of the original invoice.

We offer a world class delivery service by partnering with a reputable courier to deliver your order directly to your door. Alternatively, we can deliver to a store near you if you select the Click and Collect option on checkout. This allows you to shop anywhere, at any time, at your convenience.

If your order value is less than R 799, the delivery fee will be confirmed at the final order confirmation stage.

We have a central warehouse in George and stores nationwide, which allows us to process your order as efficiently as possible, meaning delivery of your order will take between 3 – 7 working days. Please note however that during Sales and Special Events delivery may take up to 10 working days. If we anticipate that delivery will take longer than this, we will contact you to let you know. All orders placed on weekends will be processed on the following Monday. Deliveries are only made to valid addresses within South Africa, on business days only (which excludes Saturdays and Sundays).

You or a person authorised to accept delivery on your behalf, must be available during normal business hours at the delivery address specified in the Order Confirmation (“Delivery Address”). Any person accepting delivery of the Products may be required to produce a form of identification.

DENIM CARE GUIDE

We asked our denim experts for their top tips to keep their favourite denim looking like new, and how to break them in just right. Follow these easy-care suggestions to keep your denim looking & feeling its best.

WASHING

  • Wash dark denim before the first wear to prevent dyes from bleeding. Add ½ cup of white vinegar to the water when you wash your jeans for the very first time to set dark dye.
  • Launder jeans only once or twice a month. It is best to wash jeans by hand using mild liquid detergent; however, you may also machine wash using a cold setting.
  • Air dry flat to retain shape. Only use the dryer for denim if your goal is shrinkage. If you choose to use the dryer, dry on low heat for 20 minutes then air dry the rest of the way.

WEARING

  • If you think your jeans need to be hemmed, wash them first. Denim tends to shrink length-wise and hemming beforehand can leave you with unintended high waters.
  • If you want a broken in look, spray your jeans with water as you’re wearing them around the house to get natural creases and worn-in effects.
  • To keep denim fresh between washings, rub them with a dryer sheet. You can also spray them with a fabric refresher or hang them outside.

STORING

  • The best way to store denim is to hang from the belt loops. This reduces unwanted creases and wrinkles. Attach two S hooks onto a regular pants hanger and hang by the outside belt loops.
  • When hanging jeans, don’t use hangers with clips. The teeth can dig into your denim and create impressions on the waist, knees, or cuffs.
  • Another option is to fold your denim into stacks like you see in retail stores, with the zipper on the inside of the fold.
